When Should You Seek a Custody Modification?

If there has been a material change in circumstance since the last time you got a custody order then you should seek a modification of child custody. A material change in circumstance is a significant change that occurs in your child’s life. This change may be that you or your co-parent moved out of state or you as a result of your current living situation or work arrangements are no longer able to abide by the current court order. Another material changing circumstance could be that your child’s not coping well with school or any other issues that may arise. That may mean that a new court order may be in your child’s best interest.

What Is the Difference Between Custody Modification and Custody Establishment?

The major difference between custody establishment and custody modification is that custody establishment is typically your initial custody order whereas with the custody modification it’s typically a subsequent custody order and because its a subsequent custody order it requires a significant change to occur before a court is likely to modify your custody order.
