Today, we will be discussing what is a pendente lite hearing and how are those hearings handled in Prince George’s County, Maryland.
What Is A Pendente Lite Hearing in Prince George’s County, Maryland?
A pendente lite hearing or a pendente lite hearing is a temporary relief hearing. The court can address issues of temporary access, temporary alimony, attorney’s fees, and use in possession. Alimony is spousal support use and possession is use of a family owned vehicle or use of the marital residence for someone who has primary or custody of the children.
What Is The Purpose of a Pendente Lite Hearing?
The purpose of a pendente lite hearing is to address concerns that need to be addressed immediately. They have issues that if not resolved, they would just be outstanding for the six, nine months, or even a year before you actually have your hearing. If certain issues require immediate order or immediate attention, a pendente lite hearing is a very good way for the court to economically deal with those issues. A pendente lite hearing is a very good way for the court to economically deal with issues with imminent concerns.
What Happens At A Prince George’s County Pendente Lite Hearing?
In Prince George’s County, pendente lite hearings are typically set in front of a family law magistrate. Family law magistrate is an attorney appointed by the court to address issues concerning domestic related matters. Family law magistrates are officials appointed to address domestic concerns from paternity, temporary support, alimony, all of the issues that arise from family law cases for the most part a family law magistrate can address them. At a pendente lite hearing the family law magistrate will determine what the pendente lite issues are or make a recommendation for interim or temporary order so that a judge can sign off on that order and your family can receive relief as soon as possible.
Preparing For Your Prince George’s County, Maryland Pendente Lite Hearing
If you have a pendente lite hearing coming up in Prince George’s County, it is key that you properly prepare for your hearing. If you have expenses for your children, bank statements, W2S, pay stubs, child care expenses, you want to bring those documents with you to the court so that the family law magistrate can make a recommendation for your pendente lite order.
What Happens After Your Prince George’s County, Maryland Pendente Lite Hearing?
After the pendente lite hearing, even though the order is not in effect you should abide by the terms set out by the magistrate. They will make recommendations and a judge will ultimately enter those recommendations as an order. You want to follow the recommendations regarding access and if child support is ordered, you want to make sure you’re paying the child support. Sometimes with child support if it’s ordered to have a wage link entered, it may be months before that order is actually entered. You want to make sure that if you’re ordered to pay child support you are actually paying the child support and you want to make sure that you’re tracking the actual payments you’re ordered to pay.
