With a peace order you have limited relief. You can seek a stay away order from your place of employment. You can also seek a stay away order from your residence. You can request that that person have no violent contact with you for up to six months.

Who Is Eligible for Seeking a Protective Order in Maryland?

Anyone who is in an intimate relationship can seek a protective order in Maryland. Whether you’re married or whether you are dating or whether you were previously dating and you now have a child in common.

What Type of Relief Can You Receive for a Protective Order?

With a protective order you have a wide variety of relief you can request family maintenance which is spousal support. You can request child custody. You can request use and possession of the marital home, as well as use and possession of the vehicle. You can also request that that person stay away from your child’s school, your place of employment, and your residence.

What Are The Major Differences Between a Peace Order and a Protective Order in Maryland?

There are a couple major differences between a peace order and a protective order in Maryland. A peace order typically you’re only able to have about six months of relief when you obtain a peace order from a non-intimate partner. With a protective order you can have 12 months or even up to two years if you have it extended.

Also with a protective order you are eligible for more forms of relief. With the peace order you’re eligible for stay away orders primarily no contact but when it comes to a protective order you’re eligible for support as well as use and possession of vehicles and the residence even if you don’t own the residence.
